Mochi — Terms of Service

These terms apply to Mochi: AI Pose Coach Camera ("Mochi", "the app"), an AI selfie and pose-coaching camera made by ZET Studios Inc. ("ZET Studios", "we", "us") of Langley, British Columbia, Canada. Mochi is available on Android (com.mochicam.app) and iOS. By downloading or using Mochi you agree to these terms. Anything they don't cover is governed by the general ZET Studios Terms of Service.

1. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to use Mochi on devices you own or control, for your own non-commercial use, in line with these terms and the rules of the store you got it from. If you got Mochi from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies. If you got it from Google Play, the Google Play Terms of Service also apply.

2. Your photos and content

Photos and videos you take or import with Mochi belong to you. We don't claim any ownership of them. As explained in the Mochi Privacy Policy, the camera feed, effects, filters and face, pose and scene detection run on your device, and your photos are not uploaded to us. Photos are saved to your device's photo library or shared only when you choose to.

You are responsible for the photos you take, save and share, including having permission from anyone else who appears in them.

3. AI suggestions

Mochi's pose coach, framing hints, auto-capture, beauty effects and other suggestions are generated automatically and provided "as is". They are creative suggestions, not professional advice, and may not always be accurate or suit you. Please use your own judgement — and stay aware of your surroundings while posing or shooting.

4. Acceptable use

Don't use Mochi to:

break the law, or take, edit or share photos in a way that does;
photograph, edit or share images of other people without their consent, or in places where they have a reasonable expectation of privacy;
create or share sexual content involving minors, or content that harasses, bullies, defames, impersonates or deceives anyone; or
reverse-engineer, copy, modify, resell or redistribute the app, or get around its features, limits or ads, except where the law allows it.

5. Mochi Pro subscription

Mochi Pro is an optional auto-renewing subscription. The available periods and price are shown in the app before you buy. Payment is charged to your Google Play account (Android) or Apple account (iOS) when you confirm the purchase.

Renewal. Your subscription renews automatically at the same price and period until you cancel. It renews unless you cancel at least 24 hours before the end of the current period.
Cancelling. Cancel any time in the store you bought it from — on Android: Google Play → Profile → Payments & subscriptions → Subscriptions; on iPhone: Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep Pro until the end of the period you've paid for.
Refunds. Purchases are billed by Google or Apple, so refunds are handled by them under their refund policies. We can't issue refunds directly.
Changes. If the subscription price changes, the store will tell you in advance as its rules require.

6. Ads

The free version of Mochi shows ads delivered by Google AdMob, including optional rewarded ads that can unlock a look or feature for a limited time, as described in the app. Rewards have no cash value and can't be exchanged or transferred. Mochi Pro removes ads. How ads use data is explained in the Mochi Privacy Policy. We're not responsible for the content of third-party ads or the sites they link to.

7. Intellectual property

Mochi itself — its software, design, looks, filters, effects, name and logo — belongs to ZET Studios or our licensors and is protected by law. These terms don't give you any rights to it beyond the licence in section 1. Your photos remain yours (section 2).

8. Disclaimers

Mochi is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including that the app will be uninterrupted, error-free or work on every device. Keep your own backups of photos that matter to you — we can't recover photos deleted from your device or the in-app album.

9. Limitation of liability

To the fullest extent permitted by law, ZET Studios is not liable for indirect, incidental, special or consequential losses, or for loss of data, photos, profits or goodwill, arising from your use of Mochi. Our total liability for any claim is limited to the amount you paid for Mochi Pro in the 12 months before the claim, or CAD $50 if you paid nothing. Nothing here limits liability that cannot lawfully be limited, or rights you have under consumer protection law.

10. Ending your use

You can stop using Mochi at any time by deleting it (remember to cancel Mochi Pro in the store too). We may suspend or end your licence if you break these terms.

11. Changes

We may update these terms. When we do, we'll change the "Last updated" date above, and material changes will be noted in an app release. Continuing to use Mochi after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute will be handled by the courts of British Columbia, unless the law where you live gives you the right to bring a claim elsewhere.
